OUR FEES

RESIDENTIAL CONVEYANCING FEES

We provide a fixed fee for residential conveyancing and we do not charge for completing a Stamp Duty Form, acting on behalf of your lender, or for storing your file. Our fees range from £250 – £1,200 exclusive of VAT depending on the type of transaction, the value of the Property, whether the Property is Leasehold, Freehold, a New Build, or whether you are using the Help to Buy Equity Scheme. There are of course circumstances that may make matters complicated and time-consuming whereby we are required to make additional charges. We would refer you to the ‘Other Fees’ section on this page for further information.

SELLING YOUR PROPERTY

Our fees range from £700 – £925 plus VAT based on the sale price of your Property.

The disbursements you are likely to incur are as follows:-

  • Land Registry documents: £15 (approx.)
  • Bank Transfer Fee: £35 plus VAT (to redeem any existing mortgage you may have or to send any net sale proceeds to you once completion of your sale has taken place). Please note this fee is payable per transfer.

If the Property is Leasehold, please note that we do charge an additional £100 plus VAT.

You may also be required to pay for a Management Pack for your buyer and this is customary on most sales of Leasehold Property. A Management Pack can vary in price from £100 – £500 depending on the individual Management Company and their charges.

 

BUYING A PROPERTY

Our fees range from £725 – £1,050 plus VAT based on the purchase price of the Property.

The disbursements you are likely to incur are as follows:-

  • Searches: £350 (approximately and dependent on locality)
  • Land Registry Fee £40-£910 depending on the purchase price of the Property governed by the Land Registry’s own fee scale.
  • Bank Transfer Fee: £35 plus VAT (to send purchase money to the Sellers’ solicitors
    at completion).
  • Stamp Duty: variable and based on the purchase price of the Property, whether you are a first-time buyer or whether this is an additional property. You can work out your stamp duty liability by using this calculator: https://www.tax.service.gov.uk/calculate-stamp-duty-land-tax/#/intro.

If the Property you are purchasing is Leasehold, please note that it is necessary for us to charge an additional £100 plus VAT as there is extra work required.

You may also be required to pay for further fees to the Landlord and these include:

  • Notice Fee: this is a fee payable to the Management Company to notify them of your new ownership and any mortgage on the Property. Fees vary per Management Company but are usually in the range of £50-£200 plus VAT each.
  • Deed of Covenant Fee: this is a fee payable to the Management Company when you enter into a Deed of Covenant. A Deed of Covenant is a document that you sign to confirm that you will comply with any regulations contained in the Lease.

If the Property you are purchasing is a New Build, please note that it is necessary for us to charge an additional £100 plus VAT in view of the exchange deadline and investigation of title.

If you are purchasing a Property using the Help to Buy Scheme, we charge a flat fee of £1,000 plus VAT together with the disbursements referred to above in view of the various deadlines and requirements to be dealt with.

 

REMORTGAGING YOUR PROPERTY

Our fee for a re-mortgage is £400 plus VAT. The disbursements you are likely to
incur are as follows:-

  • Land Registry documents: £15 (approx.)
  • Bank Transfer Fee: £35 plus VAT (to redeem your existing mortgage)
  • Searches: £350 (approx.) or alternatively you can take out search insurance which is based on the value of the Property and ranges from £14-£155.
  • Land Registration Fee: £20-£125 as this is based on the value of the Property governed by the Land Registry’s fee scale.
  • Notice of Charge Fee: (only if the Property is Leasehold): depending on the Management Company but approximately £50-£200 plus VAT.

 

TRANSFER OF EQUITY

This is where someone is added or removed from the ownership of a property.

Our fee for a Transfer of Equity is £500 plus VAT. The disbursements you are likely
to incur are as follows:-

  • Land Registry documents: £15 (approx.)
  • Bank Transfer fee: £35 plus VAT each (to redeem any mortgage, to send the money to the other party’s solicitors, or to send any money due back to you). Please note that fee is payable PER transfer.
  • Land Registration Fee: £20 – £125 depending on the value of the Property and based on the Land Registry’s fee scale.

 

ASSENT OF PROPERTY

This is the Transfer of Property under a Will following the previous owner’s death.

Our fee for solely an Assent is £250 plus VAT.

The disbursements you are likely to incur are as follows:-

  • Land Registry documents: £10 (approx.)
  • Land Registration fee: £20-£125 depending on the value of the Property governed by the Land Registry’s fee scale.
  • If Leasehold, a Notice Fee may be payable which depends on the Management Company but is approximately £50-£200 plus VAT.

 

LEASE EXTENSIONS

Acting on behalf of the Landlord

Our fee for preparing a Lease Extension is £1,200 plus VAT.

The disbursements you are likely to incur are as follows:-

  • Land Registry documents: £15 (approx.)
  • Bank Transfer Fee: £35 plus VAT (to send the proceeds to you at completion)

Acting on behalf of the Tenant

Our fee for reviewing a Lease Extension document is £500 plus VAT. The other
disbursements you are likely to incur are as follows:-

  • Land Registry documents: £10 (approx.)
  • Land Registration Fee: £40-£250 depending on the premium of the Lease Extension and governed by the Land Registry’s fee scale.
  • Bank Transfer Fee: £35 plus VAT (to send the premium to the Freeholders’
    solicitors).

 

OTHER FEES

Buying a Share of the Freehold: If you are purchasing a Leasehold Property and you will also be acquiring a share of the Freehold, we reserve the right to charge an additional fee of £100 plus VAT for dealing with any further work involved.

Second Charges: If you are buying or selling property with a second charge, we reserve the right to charge an additional fee of £150 plus VAT for dealing with the extra lender.

Service Charge Retentions: If you are buying or selling a Leasehold Property and a Retention is required in view of any excess service charges, we reserve the right to charge an additional fee of £150 plus VAT for retaining the sum and dealing with any post-completion payments.

Expedited Completions: Should your matter unexpectedly require urgent attention and completion is expedited in less than 5 working days, we reserve the right to charge an additional fee of £100 plus VAT. This includes simultaneous exchanges and completions.

Declaration of Trust: if you are buying jointly and one of you is contributing a higher amount, you can protect your interest by entering into a Declaration of Trust and we can prepare this on your behalf. We reserve the right to charge an additional fee of £150 plus VAT in this regard.

Dealing with Gifts from Parents or Others: if you are purchasing Property with the assistance of a gift, we are required by your lender to carry out identity and financial checks. We reserve the right to charge an additional fee in this regard of £75 plus VAT.

Separate Representation: If you are going through a relationship breakdown and we are required to liaise with your family solicitors, or if you are using a lender who has their own solicitors, we reserve the right to charge an additional fee for the extra work involved of £150 plus VAT.

Dealing with the Key Handover: If you are selling a property privately and not using Estate Agents and require us to hold the keys for your buyer and deal with the handover, we reserve the right to charge an additional fee in this regard of £50 plus VAT.

 

ABORTIVE FEES

Should your matter not proceed to completion, our abortive fee will be based on a scale of the amount of work carried out. If you would like to see a copy of our Abortive Fee Scale, please enquire when requesting a full and detailed quote from us

PROBATE AND PRIVATE CLIENT FEES

We provide fixed fees for Wills and Powers of Attorney and should you wish to contact us in this regard, please telephone the office and ask for Lesley Michalakis (John’s assistant) who will be pleased to help you.

With regards to probate fees, we provide a fixed fee based on a variety of factors. We set out below the various charges.

 

APPLYING FOR A GRANT

If the Estate contains assets (such as bank accounts with over £20,000 or Property) which require a Grant of Probate in order to close them and if you would like us to apply for the Grant, the cost will depend on the complexity of the estate and the assets held. The estimated costs will range from £500 plus VAT to £2,000 plus VAT. The exact cost will depend on the individual circumstances of the matter.

 

COLLECTING AND DISTRIBUTING ASSETS

Once the Grant of Probate has been obtained and you would like us to collect in all assets and distribute them in accordance with the terms of the will, the costs will again depend on the complexity of the estate, the number of beneficiaries and the number of assets held. The estimated costs will range from £500 plus VAT to £2,500 plus VAT. The exact cost will depend on the individual circumstances of the matter

 

PROPERTY

If there is Property involved, we will charge 0.5% of the value of the house in addition to the fees set out above.

COMPLICATED ESTATES

If the matter becomes protracted or complicated, such as if there is no Will or if the Estate consists of shareholdings (such as stocks, shares and bonds), then any additional work involved will be charged on an hourly rate of £200 plus VAT.

 

WHERE WHETHAM & GREEN ARE EXECUTORS

In cases where a partner has been appointed Executor or joint-Executor, we reserve the right to charge 1.5% of the Property value plus 1% of the remainder of the Estate value.

 

DISBURSEMENTS YOU ARE LIKELY TO INCUR

The disbursements noted here are payable to third parties. We handle the payment of the disbursements on your behalf to ensure a smoother process.

  • Probate application fee to the Court of £155 approximately.
  • £7.00 Swearing of the oath (per executor)
  • £62.15 Post in The London Gazette – this protects against unexpected claims from unknown creditors.
  • £50 approximately. Posted in a Local Newspaper – This also helps to protect against unexpected claims. The exact cost depends on the individual newspaper.
